On January 29, 1973, two men robbed a grocery store in Seattle. One of them brandished a knife described by the victim as a "kitchen knife, not too long, but a little longer than a paring knife." Phillip R. Braun was arrested outside of a halfway house for parolees, where he was then residing, within minutes after the robbery with unexplained currency in his possession. D. J. Johnson, a resident of the same halfway house, was arrested 2 days later. Both were convicted of robbery while armed with a deadly weapon. Both appealed the convictions and their appeals were consolidated.
